These Terms of Service ("Terms") govern your use of the iapom website at iapom.com (the "Site") and the purchase of website design and development services (the "Services") provided by iapom ("we," "us," or "our"). By accessing the Site or purchasing Services, you agree to be bound by these Terms.

Please read these Terms carefully before placing an order. If you do not agree, do not use the Site or purchase Services.

1. Services

iapom provides no-code website design and development services. The scope of each project is defined by the service tier purchased (Starter, Business, or Custom) as described on our Pricing page at the time of purchase.

We reserve the right to modify our service offerings and pricing at any time. Changes will not affect orders already placed and confirmed.

2. Orders and payment

All orders are placed through our secure checkout, processed by GoDaddy Payments. By placing an order, you represent that you are authorized to use the payment method provided and that the billing information you supply is accurate.

Payment is due in full at the time of purchase. We will send an order confirmation to the email address you provide. Your project will be scheduled upon receipt of confirmed payment.

All prices are listed in US dollars and are exclusive of any applicable taxes, which are your responsibility.

3. Project process and delivery

After payment is confirmed, we will contact you within one business day to schedule a kickoff call and gather the materials needed to begin your project (content, brand assets, preferences).

Delivery timelines (e.g., "5 days") are estimates that begin once we have received all required materials from you. Delays in providing materials will extend the delivery timeline accordingly.

We will deliver the completed website to you for review. You will have the opportunity to request revisions as specified in your service tier. Revision requests must be submitted within 14 days of delivery.

4. Refund policy

We want you to be satisfied with your website. Our refund policy is as follows:

• Before kickoff: Full refund if you cancel before the kickoff call has taken place.
• After kickoff, before delivery: 50% refund if you cancel after the kickoff call but before we deliver the first version of your site.
• After delivery: No refund once the completed website has been delivered for review, as the work has been performed.

5. Your responsibilities

You agree to:

• Provide accurate, complete information when placing an order and during the project
• Supply all required content, images, and brand assets in a timely manner
• Ensure that any content you provide does not infringe third-party intellectual property rights, violate any law, or contain defamatory, obscene, or harmful material
• Use the completed website only for lawful purposes

6. Intellectual property

Upon receipt of full payment and delivery of the completed website, you own the website and its custom design elements created specifically for your project.

iapom retains ownership of any underlying frameworks, templates, tools, and methodologies used in building your website. These are licensed to you for use in the delivered website but may not be extracted, resold, or used independently.

You retain full ownership of all content you provide (text, images, logos, etc.).

7. Limitation of liability

To the maximum extent permitted by applicable law, iapom's total liability to you for any claim arising out of or relating to these Terms or the Services shall not exceed the amount you paid for the specific service giving rise to the claim.

In no event shall iapom be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, even if advised of the possibility of such damages.

8. Disclaimer of warranties

The Site and Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Governing law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.

10. Changes to these Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Continued use of the Site or Services after changes constitutes acceptance of the updated Terms.
